The use of this site is governed by the Terms and Conditions of Use set forth below and elsewhere on the site as indicated. By using this site, you agree to these Terms and Conditions of Use.
Óptica Ibérica is an online store selling replacement contact lenses and accessories at significant discounts to the traditional way of buying your contact lenses from your regular Optician.
You confirm that you will only place orders for contact lenses that have been prescribed by a contact lens specialist (ophthalmologist or optician), and that your contact lens prescription has been issued within the last 12 months of the order.
By your order you confirm that you are at least 18 years old and undergo regular checks by your contact lens specialists (at the interval recommended by your contact lens specialists).
Privacy.
We protect your privacy and your data will not be given to any third party.
Payment.
We accep the following payment methods:

We use PayPal to process Credit Card payments. Paypal is a convenient and secure method for online payments.
Note, that you do not need to have a PayPal account to make a credit card payment to us.
In Portugal, we also offer payment at delivery for most products.
If you order from our internet page, the total price you pay is the price of the products + freight.
If you order from us in another way, the following conditions apply:
As this is more expensive for us, there will be an additional handling fee of €3,- to your order.
Prices and VAT.
All prices are marked in euros and are quoted for EU counties as inclusive of statutory VAT of 6,0% or 23,0%.
VAT is automatically deducted from your order if both invoice and delivery address are from a non-EU country.
Deviations or agreed additional services of the shipping costs are possible in the individual case, depending on the product and the delivery area.
Prices shall be subject to alteration without notice.
Shipping & Delivery Times.
1. Standard products: The majority of daily, 1-2 week and monthly lenses:
The majority of the orders are shipped between 1-3 days.
2. Special lenses: Toric lenses, colored lenses, hard/RGP lenses, annual lenses, "fun" lenses and any product that is a made-to-order product:
These products are always ordered directly from the manufacturer. The delivery time depends on the lens type/model (variable).
Delivery time is the estimated time from we send the lenses and until you should receive them.

Total time (the time from you order and until you receive the products) is dependent on the availability of the item/s in your order. A total delivery date can in principle not be guaranteed, since we have no influence on delays in delivery by the manufacturer and/or the shipping partners or force majeure.
Delivery Costs and Further Delivery Time Information
The shipping expenses are:
Portugal: €4,50 if payment by PayPal or Credit card, €2,95 if payment by bank transfer or €4,90 if payment at delivery.
Spain: 7,50 if payment by PayPal, Credit card or wire transfer (bank transfer). Payment at delivery is not available.
Rest of Europe: €6,95 (payment by Credit card or PayPal), €3,95 if payment by bank transfer.
Note, mainly for non-EU countries: To avoid unexpected customs fees or duties, check with the customs department in your country about its importation policies.
We are NOT responsible for any sales taxes, customs duties or other taxes charged by your country'.
Return policy.
1. Standard contact lenses can be returned to us, or exchanged.
You must contact us first, to receive a return-number. Without this return-number, we will not accept your return. Just send the lenses to us
- unopened (unopened containers / boxes or packaging)
- in the original packaging, and suitable for re-sale again
- with the return-number you have received from us
- with a copy of the order or invoice
- the reason for the return
- within 14 days after reception of the lenses
and we will exchange your lenses or refund your money within 30 days. Refunds will normally be made by re-crediting the payment card account from which the money was originally debited, or by transfer to your bank account.
Note:
Disposable lenses in soft secondary packaging - so-called blisters, can not be returned, since these are not suitable for resale.
You are responsible for the shipping and shipping costs to us. Please keep a "proof of postage" when returning goods.
2. Non-standard contact lenses can not be exchanged, returned or canselled:
- colored contact lenses
- special designs (e.g. toric lenses, multifocal lenses etc.)
3. Defective lenses
Defective lenses can be exchanged for the same product if the manufacturer confirms the defect. Just send the defective lens to us + the original packaging within 14 days after the invoice date.
Please include your name, order number, and the reason for the return.
When the lens manufacturer agrees that the lens is defective, a replacement lens will be sent to you at no cost.
We cannot issue refunds for defective items.
No Professional Advice
Any information supplied through this website or by any of our employees or agents, whether by telephone, e-mail, letter, facsimile or other form of communication, is for informational purposes or general guidance and does not constitute medical or other professional advice.
Liability and Claims for Damages
The customer shall indemnify us against any liability for health damage that was possibly caused by wearing the contact lenses or by using care products, cosmetics and accessories. The customer affirms that it will only place orders for contact lenses that have been fitted properly by a contact lens specialist (ophthalmologist or optician) and well tolerated without exception. Claims for damage that can be caused by an improper own fitting shall not be asserted. Furthermore, regular checks by a contact lens specialist shall be taken for granted.
Claims for damages shall be restricted to the amount of the order value.

You may use the content on our web site only for your own personal, non-commercial shopping and information purposes.

Reselling Products Prohibited
Non-professional clients are absolutely prohibited from reselling in any manner any products you purchase from us, whether you purchased the products through the website or by any other means. We reserve the right to refuse to sell products to you if it reasonably appears to us that you intend to resell the products. In addition, we reserve the right to limit quantities of items purchased by each customer.
Product Illustrations / FAQ / Product Information.
Product illustrations may deviate from the appearance of the delivered products in the individual case. The product information are mainly details given by the manufacturer. We assume no liability for the information made available. Mistakes and printing errors reserved.
Trademarks
Óptica Ibérica, as well as other names, button icons, text, graphics, logos, images, designs, titles, words or phrases, audio clips, page headers and service names used on this web site are the trademarks, service marks, trade names or other protected intellectual property of Óptica Ibérica, or it's owner. They may not be used in connection with any third party products or services. All other brands and names are the property of their owners.
Place of Jurisdiction
The place of jurisdiction shall, as far as legally permissible, be Setubal/Portugal. The place of performance shall be the registered office of the company. For all legal relations between us and the party ordering, the law of the Portugal shall apply to the exclusion of the Vienna Convention on the International Sale of Goods 1980 (CISG), even if the party ordering has its registered office abroad. The language of the court shall be Portuguese.
In these terms and conditions: Óptica Ibérica is a trade mark / service of Advanier, Lda (Portugal). "Óptica Ibérica " means, Óptica Ibérica / Advanier, Lda. and any successor in title: "We and Us" means Óptica Ibérica / Advanier, Lda. either as an individual corporate entity or together with you, as the context requires. "You" means the person ordering goods subject to these terms and conditions.
